Notice of Intent to Prosecute (NIP’s)
If an offence of excess speed is detected by a camera/laser/video/radar device and the driver is not stopped at the time, a Notice of Intended Prosecution (NIP) is issued within 14 days to the registered keeper of the vehicle as shown on DVLA records.
Subsequent Notices of Intended Prosecution may be issued if it transpires that the registered keeper was not actually the keeper at the time of the offence. In each case, the person/company to whom/which the form is addressed must complete and return it within 28 days, giving details of the driver at the time of offence.
If the information is not provided within the 28 day period, the recipient of the form could be liable to prosecution under Section 172 of the Road Traffic Act 1988 for failure to provide driver details. Failure to complete and return the driver information form may result in the registered keeper being prosecuted for failing to provide the information. If found guilty, the courts can impose 6 penalty points and a fine.
