Conditional Offers (CO’s)


Once a driver has been identified, in some cases it is possible to deal with the offence by FIXED PENALTY PROCEDURES and the driver will then be sent a CONDITIONAL OFFER.
This states that the matter can be completed without recourse to court proceedings, by payment of a fixed penalty (currently £60) and a driving licence endorsement of three points, subject to the following conditions:

1) that there are not more than 8 penalty points already on the driver's licence
2) that the licence was issued in the UK by the DVLA at Swansea
3) that the recorded speed is less than 20mph above a 30mph speed limit or 26mph above any other speed limit in force.
4) that the licence (both parts, if a photocard type) is submitted within 28 days, together with a completed statement from the driver and payment of the £60 fixed penalty. Please ensure that if you have a photocard licence, that the issue number for both parts match.

When you have completed the conditional offer form, this can be sent with your payment by post (please ensure you affix the correct postage) to the Fixed Penalty Clerk, Court House, 80, Victoria Avenue, Southend-on-Sea, Essex SS2 6EU. Payment can be made in the form of a cheque payable to "HMCS (Her Majesty's Court Services)", postal order or by giving credit/debit card details. C

Even if a conditional offer of a fixed penalty is given, it does not have to be accepted and if the driver wishes to be dealt with by a court hearing, he/she should forward a letter stating that they wish to contest the penalty enclosing their conditional offer to MSD Safer Roads Bureau, 147 High Street, Billericay, Essex CM12 9AB  within the 28 day period. A court date will then be notified in due course.
