Bus Gate Enforcement in Essex

THE ENFORCEMENT PROCESS

The Penalty Charge Notice (PCN):- The PCN normal rate is £60.00 but if paid within 14 days of the offence it reduces to £30.00. If paid after 28 days of the offence the costs will rise to £90.00.

If you wish to challenge the PCN:- You have the chance to appeal against the PCN if you feel it has been issued incorrectly but evidence is required and will need to be presented in writing to the address provided on the PCN. The charge will not increase whilst your challenge is being considered. The decision of Essex County Council will be notified to you in writing.

If your challenge is accepted:- The PCN will be cancelled on the database and you will receive written notification of this.

If your challenge is rejected by Essex County Council:- Essex County Council will send you an appeals form that you will need to complete and send to the Traffic Penalty Tribunal (TPT).  TPT are an independent adjudication service and their decision will be final.

If you complete an appeals form:- Completed appeals forms should be sent to TPT and the address can be found on the appeals form. TPT will notify Essex County Council that an appeal has been received by them.  This will put the PCN on hold until the outcome, made by the independent adjudicator, is known.  This decision will be final.

How the appeal form will be dealt with:- The appeal can be heard by post or at a personal hearing.  If the adjudicator allows the appeal Essex County Council will be notified to cancel the PCN. If the adjudicator dismisses the appeal you will have 28 days to pay the PCN.

If you do not challenge or pay the PCN:- If payment is not received within 28 days and no challenge is received the charge will rise to £90.00 and you will receive a Charge Certification.

The Charge Certification:- If you receive a charge certification this is because no payment or challenge has been received for the PCN. The amount due is now at £90.00. At this stage it is too late to appeal.  If payment is received within 14 days then the PCN will be closed.  If no payment has been made within 14 days Essex County Council will register the debt in the County Court.

Debt Registration in County Court:- Essex County Council will send a Notice of Debt and the charge will now be £95.00.  If payment is received within 21 days the case will be closed.  If payment is not received within 21 days Essex County Council will obtain a warrant from the county court and Bailiffs will be instructed to recover the debt. Once the Bailiff has become involved Essex County Council can no longer enter into dialogue or correspondence with you.


What forms of payment can I make?
Present payment methods are either by Postal Order or Cheque sent to the address on the PCN.  Please include your PCN on the back of the cheque or include it in the paperwork for postal orders. Make them either payment method out to Essex County Council.

What if I’ve sold my car before the offence took place?
If you have sold the car before the offence took place then you will need to put this in writing with any evidence to the address shown on the PCN.

What if my car was stolen before the offence took place?
If your car was stolen before the offence took place you will need to put the evidence in writing to the address shown on the PCN.
